Access to the property will be required to undertake these services and it is assumed that access will be freely available in normal working hours.
The proposal is inclusive of site visits inclusive of reasonable travel and expenses where stated only.
Measured surveys will be undertaken with laser measuring equipment and while every effort is made to assess all details accurately it may be difficult to precisely capture all areas especially where access is limited. Surveys will be non-intrusive unless otherwise agreed.
documents drawings will be issued in an electronic PDF format and charges will apply for printed versions. CAD files will not be issued and we retain all control and ownership.
All drawings represent design intent and concept and we accept no liability whatsoever if this drawing is used by anyone for any other purpose.
Any revisions to design information shall be limited to 2 only. Additional fees charged at our standard rate or agreed separately for any additional work.
The set out fees are based upon the full service being undertaken and any applications being approved within the initial determination period, we withhold the right to charge additional fees to cover extra work required to satisfy the Local Authorities requests, further applications and additional client/ contractor requests. Our standard hourly rate for additional work is £95 plus VAT, unless otherwise agreed.
Fees will be subject to VAT at the current prevailing rate.
A deposit payment will become payable immediately on appointment and further payments will be invoiced on completion of each service detailed within this agreement and in advance of 3rd party costs being due. The initial payment will be deducted from the final invoice, where applicable. Any payment in absence of a signed agreement shall be construed as accepting our Terms of service and proposed services. All non electronic payments (e.g. Cheque) are subject to an administration fee.
If full payment is not made within our invoice terms, collection will be passed to our third party debt recovery specialists where a charge of 15% plus vat will be incurred on the unpaid amount. Additionally, Statutory Interest will also be applied to the unpaid amount.
Any build and construction costs are issued for guidance only and are not final. These will be subject to final design and market tested contractor/ builder/ trades costs on commencement of the project.
Inner Create Ltd. holds Professional Indemnity Insurance for it’s Design Services with a limit of Indemnity of £500,000.00, plus Public Liability Insurance with a limit if Indemnity of £2,000,000
The client acknowledges its responsibilities under the Health and Safety Act.
With the introduction of the act from 1st October 2023 this brings new roles and responsibilities for the Designers, Builders and Clients and further information on this can be found at https://www.legislation.gov.uk/ukpga/2022/30/contents/enacted
It is specifically noted that we can only take responsibility for the full design (as Principle Designer) under the act where we have a full appointment for the whole project and through all phases. Where we are only appointed for the early stages of the project for instance for Building Control drawings only then we will take responsibility for this stage but the design responsibility will be passed onto the client and the builder at the end of our appointment.
In the event of a dispute between the parties the Contract Administration shall make all reasonable efforts to resolve the dispute by amicable negotiations between the parties. If this is not resolved satisfactorily then either party may invoke arbitration by giving written notice to the other party.
This agreement shall be construed in accordance with English Law and the courts of England and Wales, in whole or part.
In the event of terminating this agreement the full fee or proportion of will become immediately payable, subject to the amount of work completed and committed to at the date of termination.
We may take photographs of your property and reserve the right yo use these for marketing purposes.
Where we are responsible for the construction (acting as building contractor) the maximum Defects Liability Period shall be 12 months unless stated otherwise in the building contract.
Any personal data will be held and used for the purpose of undertaking our services and will be controlled by Inner Create Ltd for this purpose. Local Authorities and 3rd Parties directly connected with our services will require us to disclose your details for the purpose of any applications or connected services and we will limit the distribution of these details. You have the right to withdraw the consent to use your information and to lodge a complaint with the supervisory authority at any time.
